(a) EnvisionVR Pty Ltd respectsyour right to privacy and is committed to safeguarding the privacy of ourcustomers and website visitors. This policy sets out how we collect and treatyour personal information.

(b) We adhere to the AustralianPrivacy Principles contained in the Privacy Act 1988 (Cth) and to the extentapplicable, the EU General Data Protection Regulation (GDPR).

(c) “Personal information” isinformation we hold which is identifiable as being about you. This includesinformation such as your name, email address, identification number, or anyother typeof information that can reasonably identify an individual, eitherdirectly or indirectly.

2. What personal information iscollected

(a) EnvisionVR Pty Ltd will, fromtime to time, receive and store personal information you submit to our website(s), applications(s) orprovided to us directly or given to us in other forms.
(b) You may provide basic informationsuch as your name, phone number, address and email address to enable us to sendyou information, provide updates and process your product or serviceorder.
(c) We may collect additionalinformation at other times, including but not limited to, when you providefeedback, when you provide information about your personal or business affairs,change your content or email preference, respond to surveys and/or promotions,provide financial orcredit card information, or communicate with our customersupport.
(d) Additionally, we may alsocollect any other information you provide while interacting with us.

3. How we collect your personalinformation

(a) EnvisionVR Pty Ltd collectspersonal information from you in a variety of ways, including when you interactwith us electronically or in person, when you access our website and when weengage in business activities with you. We may receive personal informationfrom third parties. If we do, we will protect it as set out in this PrivacyPolicy.
(b) By providing us with personalinformation, you consent to the supply of that informationsubject to the termsof this Privacy Policy.

4. How we use your personalinformation

(a) EnvisionVR Pty Ltd may usepersonal information collected from you to provide you with information aboutour products or services. We may also make you aware of new and additional products, services and opportunities available to you.
(b) EnvisionVR Pty Ltd will usepersonal information only for the purposes that you consent to. This mayinclude to:

(i) provide you with products andservices during the usual course of our business activities;

(ii) administer our businessactivities;

(iii) manage, research and developour products and services;

(iv) provide you with informationabout our products and services;

(v) communicate with you by avariety of measures including, but not limited to, by telephone, email, SMS ormail; and

(vi) investigate any complaints.

If you withhold your personalinformation, it may not be possible for us to provide you with ourproducts andservices or for you to fully access our website.

(c) We may disclose your personalinformation to comply with a legal requirement, such as a law, regulation,court order, subpoena, warrant, legal proceedings or in response to a lawenforcement agency request.
(d) If there is a change ofcontrol in our business or a sale or transfer of business assets, wereserve the right to transfer to the extent permissible at law our user databases, together with anypersonal information and non-personal information contained in those databases.

5. Deletion of Personal Information

Users may make a request to have personal information deleted from our records by contacting us at info@envisionvr.com.au. We will verify your request using the information associated with youraccount, including email address. Users can also designate an authorized agent to exercise this courseof action on their behalf. Alternatively, there is an in app option to delete accounts in all of our applications, if “Accounts” ispressed in the main menu there is an option to “Delete Account”.

6. Disclosure of your personalinformation

(a) EnvisionVR Pty Ltd maydisclose your personal information to any of our employees, officers, insurers,professional advisers, agents, suppliers or subcontractors insofar asreasonably necessary for the purposes set out in this privacy policy.
(b) If we do disclose yourpersonal information to a third party, we will protect it in accordance withthis privacy policy.

7. General Data ProtectionRegulation (GDPR) for the European Union (EU)

(a) EnvisionVR Pty Ltd willcomply with the principles of data protection set out in the GDPR for thepurpose of fairness, transparency and lawful data collection and use.
(b) We process your personalinformation as a Processor and/or to the extent that we are a Controller asdefined in the GDPR.
(c) We must establish a lawfulbasis for processing your personal information. The legal basis for which wecollect your personal information depends on the data that we collect and howwe use it.
(d) We will only collect yourpersonal information with your express consent for a specific purpose and anydata collected will be to the extent necessary and not excessive for its purpose. We will keep your data safe and secure.
(e) We will also process yourpersonal information if it is necessary for our legitimate interests, or tofulfil a contractual or legal obligation.
(f) We process your personal informationif it is necessary to protect your life or in a medical situation, it isnecessary to carry out a public function, a task of public interest or if thefunction has a clear basis in law.
(g) We do not collect or processany personal information from you that is considered “Sensitive PersonalInformation” under the GDPR, such as personal information relating to yoursexualorientation or ethnic origin unless we have obtained your explicitconsent, or if it is beingcollected subject to and in accordance with theGDPR.
(h) You must not provide us withyour personal information if you are under the age of 16 without the consent ofyour parent or someone who has parental authority for you. We do not knowinglycollect or process the personal information of children.

8. Your rights under the GDPR

(a) If you are an individualresiding in the EU, you have certain rights as to how your personal informationis obtained and used. EnvisionVR Pty Ltd complies with your rights under theGDPRas to how your personal information is used and controlled if you are anindividual residing in the EU

(b) Except as otherwise providedin the GDPR, you have the following rights:

(i) to be informed how yourpersonal information is being used;


(ii) access your personalinformation (we will provide you with a free copy of it);


(iii) to correct your personalinformation if it is inaccurate or incomplete;


(iv) to delete your personalinformation (also known as “the right to be forgotten”);


(v) to restrict processing ofyour personal information;


(vi) to retain and reuse yourpersonal information for your own purposes;


(vii) to object to your personalinformation being used; and


(viii) to object againstautomated decision making and profiling.

(d) We may ask you to verify youridentity before acting on any of your requests.

9. Hosting and International DataTransfers

(a) Information that we collectmay from time to time be stored, processed in or transferred between parties orsites located in countries outside of Australia. These may include but are notlimited to EVR clients and EVR partners worldwide.
(b) We and our other groupcompanies have offices and/or facilities in Australia, Europe and United Statesof America. Transfers to each of these countries will be protected byappropriatesafeguards, these include one or more of the following: the use of standarddata protection clauses adopted or approved by the European Commission whichyou can obtain from the EuropeanCommission Website; the use of bindingcorporate rules, a copy of which you can obtain from EnvisionVR Pty Ltd’s DataProtection Officer.
(c) The hosting facilities forour website are situated in Australia and the United States of America.Transfers to each of these Countries will be protected by appropriatesafeguards, theseinclude one or more of the following: the use of standarddata protection clauses adopted or approved by the European Commission whichyou can obtain from the European Commission Website; the use of bindingcorporate rules, a copy of which you can obtain from EnvisionVR Pty Ltd’s DataProtection Officer.
(d) Our Suppliers and Contractorsare situated worldwide. Transfers to each Country will be protected byappropriate safeguards, these include one or more of the following: the use ofstandard data protection clauses adopted or approved by the European Commissionwhich you can obtain from the European Commission Website; the use of bindingcorporate rules, a copy ofwhich you can obtain from EnvisionVR Pty Ltd’s DataProtection Officer.
(e) You acknowledge that personaldata that you submit for publication through our website or services may beavailable, via the internet, around the world. We cannot prevent the use (ormisuse) of such personal data by others.

10. Security of your personalinformation

(a) EnvisionVR Pty Ltd iscommitted to ensuring that the information you provide to us is secure. Inorder to prevent unauthorised access or disclosure, we have put in placesuitable physical, electronic and managerial procedures to safeguard and secureinformation and protect it frommisuse, interference, loss and unauthorisedaccess, modification and disclosure.
(b) Where we employ dataprocessors to process personal information on our behalf, we only do so on thebasis that such data processors comply with the requirements under the GDPR andthat have adequate technical measures in place to protect personal informationagainst unauthorised use, loss and theft.
(c) The transmission and exchangeof information is carried out at your own risk. We cannot guarantee thesecurity of any information that you transmit to us or receive from us.Although wetake measures to safeguard against unauthorised disclosures ofinformation, we cannot assure you that personal information that we collectwill not be disclosed in a manner that is inconsistent with this PrivacyPolicy.

11. Access to your personalinformation

(a) You may request details ofpersonal information that we hold about you in accordance withthe provisionsof the Privacy Act 1988 (Cth), and to the extent applicable the EU GDPR. If youwould like a copy of the information which we hold about you or believe thatany information we hold on you is inaccurate, out of date, incomplete,irrelevant, or misleading, please email us at info@envisionvr.com.au.
(b) We reserve the right torefuse to provide you with information that we hold about you, in certaincircumstances set out in the Privacy Act or any other applicable law.

12. Complaints about privacy

(a) If you have any complaintsabout our privacy practices, please feel free to send in details of yourcomplaints to info@envisionvr.com.au We take complaints very seriously andwill respond shortly after receiving written notice of your complaint.

13. Changes to Privacy Policy

(a) Please be aware that we maychange this Privacy Policy in the future. We may modify this Policy at any time,in our sole discretion and all modifications will be effective immediately uponour posting of the modifications on our website or notice board. Please checkback from time to time to review our Privacy Policy.

(a)When you come to our website(https://envisionvr.net/), we may collect certain information such as browsertype, operating system, website visited immediately before coming to our site,etc. This information is used in an aggregated manner to analyse how people useour site, such that we can improve our service.
